1. About BOSQUE

BOSQUE (“BOSQUE,” “we,” “us”), operated by Bosque LLC, is a media publication and creative agency at bosqueculture.com (formerly bosquestyle.com) and on Instagram at @bosqueculture. We feature homes, spaces, and design, and we sell paid editorial features through the site. Where the site passes along an inquiry, it introduces you to the independent listing agents, owners, or managers connected to a property. Bosque LLC is not a real estate brokerage, is not a party to any purchase, rental, or stay, and does not hold deposits or manage property. Any transaction that follows an introduction is arranged solely between the parties to it.

2. Changes to These Terms

We may update these Terms from time to time. The current version is always posted on this page with its effective date. Continued use of the site after changes are posted means you accept the updated Terms. A feature you have already booked is governed by the Terms in effect when you booked it.

3. Property Information and Introductions

Prices, rental rates, availability, and property details are provided by the listing agent, owner, or manager, may change without notice, and are not verified by BOSQUE. Inquiries such as showing requests and rental inquiries are passed to the property’s listing agent, owner, or manager. Any resulting arrangement, including its price, dates, and terms, is made solely between you and that party; confirm everything directly with them before committing. We do not promise that any inquiry will receive a response or that any property is available.

4. Acknowledgment and Release

By inquiring about a property you found through BOSQUE, you acknowledge that each property is represented, owned, or operated by an independent third party; that BOSQUE has not inspected, verified, or certified any property, listing detail, license, or permit; and that any showing, stay, purchase, or other arrangement is solely between you and that party. To the fullest extent permitted by law, you release Bosque LLC and its owner, employees, and agents from any claim arising out of such an arrangement, including property condition, accuracy of descriptions, cancellations, refunds, and personal injury or property damage.

5. Paid Features

Booking. Features listed on the site can be booked online. A booking is a request, not a guarantee of publication. BOSQUE is an edited publication, and we review every property against the same standard as our own editorial. We may decline any booking at our sole discretion, without giving a reason.

Payment. Booking places an authorization hold on your card through Stripe; it is not a charge. If we accept the feature, the hold is captured and becomes the payment. If we decline it, or do not decide within the period your card issuer allows a hold to remain (usually about seven days), the hold is released and nothing is charged. Prices are in U.S. dollars and are those shown at checkout.

Cancellations and refunds. Once a feature is accepted and paid, the fee covers production we schedule and begin. You may cancel for a full refund until photography, filming, or design has begun. After that, fees are non-refundable, except that if we are unable to produce or publish an accepted feature, we will refund it in full.

Review and publication. Before a feature is published we share it with you for review, and we will correct any error of fact you point out. Design, editing, photo selection, headlines, and captions remain BOSQUE’s editorial decisions. Features are published on our Instagram accounts and on bosqueculture.com, and may be published in collaboration with your Instagram account. We may update a feature after publication, for example to show that a property has sold, and we decide how long a feature remains published.

Disclosure. Where the law or platform rules require, paid features are identified as paid or sponsored, for example with Instagram’s paid partnership label.

Materials and appearance. You represent that you have the right to give us the photography, video, and other materials you supply, including any permission needed from the photographer, and to have the property featured. If you or anyone you bring appears in a film or photograph we produce, you consent, and confirm that they consent, to our use of their name, likeness, and voice in the feature and in promoting it.

Review links. Links we send you to review a feature before it is published are private. Please do not share them publicly.

The sale post. The Full Feature includes a photo post when the property sells, published in collaboration with the listing agent's account and crediting them as the representative. It follows the close of escrow. If the property is withdrawn or does not sell, there is no sale post and the fee is unchanged.

Other services. Media Partnerships, campaigns, creative work, and other services quoted outside the site are governed by the proposal or written agreement for that work, which controls if it conflicts with these Terms.

6. Owner and Agent Responsibility

Property owners, listing agents, and managers are solely responsible for their properties and listings, including legal compliance, the accuracy of information given to BOSQUE, property safety, and communication with interested parties. BOSQUE does not verify licensing, permits, insurance, or property conditions, and featuring a property is not an endorsement or guarantee of any kind.

7. Use of Site Content

All content on bosqueculture.com and BOSQUE’s channels, including photography, video, text, and design, is owned by or licensed to BOSQUE and is provided for personal, non-commercial use. Agents and owners whose property we have featured may share links to the feature and our posts. Otherwise, no content may be reproduced, distributed, or used commercially without our prior written consent. If you believe content on the site infringes your rights, write to us at the address below and we will review it promptly.

8. Submissions

By submitting materials to BOSQUE, including property submissions, photographs, video, and messages (excluding personal contact information), you grant Bosque LLC a royalty-free, perpetual, irrevocable license to use, reproduce, edit, and display those materials in connection with the site, our channels, and their promotion. You represent that you have the rights to everything you submit, including photography. Submitting a property does not oblige us to feature it.

9. Prohibited Use

You agree not to submit false inquiries or fraudulent information; scrape, crawl, or harvest content or data by automated means; interfere with the operation of the site; attempt unauthorized access to any system or account; or upload malicious code.

10. Disclaimers and Limitation of Liability

The site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, Bosque LLC is not liable for errors in listings or features; the condition of any property; the acts or omissions of any owner, agent, manager, or guest; failed or disputed transactions between third parties; the results of any feature, including reach, inquiries, or sales; or any indirect, incidental, special, or consequential damages. If BOSQUE is nonetheless found liable, our total liability is limited to the amount you paid us for the feature at issue, or one hundred dollars ($100 USD) if you paid us nothing.

11. Force Majeure

BOSQUE is not responsible for failures or delays caused by events beyond reasonable control, including natural disasters, fire, weather, utility or infrastructure failures, platform outages, government action, or public health events.

12. Indemnification

You agree to indemnify and hold harmless Bosque LLC and its owner, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the site, materials you supply, any arrangement with a third party introduced through the site, or your violation of these Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the State of California. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Santa Barbara County, California.

14. Relationship of the Parties

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between BOSQUE and any owner, agent, manager, client, or visitor. Featured parties are independent third parties, and BOSQUE is not responsible for their acts or omissions.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
